CMS changed calc value 11 months into claim
« on: February 16, 2018, 12:13:43 PM »
hi all,

it would be great if there is any advice available for my situation.

I started a CMS claim against myself (yup... go figure), because the mum was asking for 3x the amount i was currently giving under our family arrangement (and almost 3.5x that of cms calcs).

I started the claim about 10 months ago and never missed payments, yet the mum has demanded a recalc on 3 occasions.... on all occasions i have sent in p60's current payslips etc.. and CMS have said the calc is accurate.

She has now gone to MP (i didn't know till i got called for CMS and the woman on the phone said my calc is now wrong).

So i need guidance on knowing whether MP's can actually force CMS to change calcs to suit (surely not) and if they change the calc am i really 11 month backdated so i have a large sum to pay?

I work for HMRC so guarentee i am not hiding income....any advice or thoughts would be great.

if they change the calc...do i have recourse to demand a review or deny payment since I already submitted a reconsideration which came back 'no change'.
